Once the case has been filed with the court, we serve the other party, and present the evidence to the court at a hearing. The other party will also have this opportunity, and ultimately the court will make every effort to resolve the situation in a manner acceptable to all parties involved.

If you are being harassed by someone, you may need to involve the court system. The courts can look at the situation objectively, and decide whether someone should be issued with a Personal Protection Order (PPO), also known as a "Restraining Order", against another person, for the purposes of stopping harassment.
These orders often empower law enforcement to act with additional powers under civil law. When someone is issued with a Personal Protection Order, it is usually because the court finds the person asking for the order is either in danger of being physically harmed, or being harassed past the point where they can enjoy their life. Once the order is issued, and served to the responding party, they are under direct jurisdiction of the court, and the order will spell out specific conditions. One of the conditions is almost always that in the event any condition on the order is violated, orders any law enforcement agency to immediately arrest the violator by order of the court, and bring them before the court, to explain why they violated the order.

Sometimes it is necessary to involve the court system if you are involved in a situation of domestic violence. It is extremely important in these instances that you document any calls to Police for help, as well as any medical treatment received as a result of domestic violence. Police reports, medical records, photos of injuries, and or bruises, are all key to proving domestic violence with the court.
A common myth is that domestic violence can only occur between a spouse or significant other. Not true. Domestic violence happens anytime there is physical abuse or harm inflicted upon one person by another in a domestic household situation. In other words, a room mate or friend who lives with another friend can be charged with domestic violence.
IF YOU ARE IN A SITUATION OF DOMESTIC VIOLENCE AND ARE IN DANGER, CALL THE POLICE IMMEDIATELY!
Once the immediate situation has been handled by the local police, it is necessary then to take longer term actions to protect yourself, and your family.
Often this action includes a Protection Order to tell the party who assaulted you that they are not to come near you again, and if they do, they will be arrested and charged with violation of a Protection Order.
In the case of extreme emergency, the court can grant an "ex-parte" order in open court, where the petitioner, or person who was assaulted, tells the court they cannot feel safe without an order, and they feel that the danger is so extreme they cannot wait for a court hearing and the other party to be present for the court to grant a Protection Order. If the court grants the order of Protection ex-parte, you will need to have the order served to the respondent, via a Process Server. Once this service is complete, if the respondent violates any condition of the order, they will be arrested immediately by a law enforcement officer.
